It still stands that Tobi can snatch Kabuto up and end it at any point. Kabuto doesn't have instant teleportation so he is screwed. Deciding factor on top of KA, CT, and C-4 bombs. Kabuto himself isn't all that great just his Edos and all those attacks named directed at Kabuto would end him and leave him dead.
