It can't be those who use ninjutsu, or can use ninjutsu: Lee
It can't be those who can use a type of it like Gen or Tai or do: Tenten only uses weapons.
It can't be those who work in ninja villages: Plenty of evidence.
Can't be chakra users:Samurai can use it.

So what, then?

Depends on who you trust. If you trust Orochimaru, you belive its the many different ninjutsu arts you master, but if you're Jiraiya, you believe a ninja is one who keeps fighting no matter what obstacle lies in his/her path.

whoever went through ninja training and passed really....more and more it's just a magic show but if you can use any kind of jutsu and have some skill in taijutsu and have officially been proclaimed a ninja, it counts.

on a serious note what makes a person a ninja is knowing ninja jutsu (technique) that they learn at the ninja academy and the village they serve.
