Pretty much, I mean it was mentioned in the anime by Momoshiki. He said when a fruit reaches level 10 it's to be harvested, yet the Earth fruit is level 16 and Kaguya hadn't reported it. I think in the filler series they will retcon it to Kaguya betraying ishiki to take the fruit.
