Not a plot hole, edo tensei has the same weakness as any other jutsu that binds, restricts or seals a person's movement/mind. If the person being controlled has strong enough chakra they can break through it.

It's no different to how Sasuke broke out of Danzo's seal, Oro's reincarnation tech and Itachi's genjutsu, or how Naruto was immune to Nagato's chakra rod when he went into BSM.

No. I don't know when Tobirama invented the technique, but it makes sense either way. If it was before Madara left the village, it'd make sense why such a highly-ranked person of the village would have access to any scrolls that Tobirama may have written. If it was after, it makes perfect sense for Madara to have used Zetsu to spy on the village and Tobirama especially.
