Personaly I think it normal that Sasuke was in jail....at least for the time Naruto and Kakashi convinc the other Kage.
Kishi was rushed to finish his manga in chapter 700 so many thing was frogotten....which not the cause of the anime which take all the time to finish (****ing 2 years).

I'm Sasuke fan, of course, Sasuke should be able to free himself but he played the role a good boy to rassure the other Kage.

This right here. It fits perfectly with what would have happened had Kishi had time to actually draw it. And I agree Sasuke was only there because he chose to be out of repentance for the role he played in all of this.

He could have easily just Amenoed right out of there or they would have never got that seal blindfold around his eyes without his consent. That part is fact
