They dead. They got deaded in the last arc, but since Soul Society is the afterlife, they got better.

Makes you wonder, though. Isn't Yhwach still supposed to be Human? So when you kill him, he just shows up 5 meters to the left in Soul Society.

Since he invaded Soul society he must have had a soul body.

Didn't Ginjo die as a Shinigami though? He should have been a soul at that point, but he's fine (for a dead guy, at least)

He died while in Fullbring bankai mode. He did use to be a shinigami but I think he used a gigai.
