Orochimaru's essence is within the curse seal. Because of this he is able to exist, he already told Sasuke that he saw everything from Anko when he saw Kabuto. He was still sealed though, it's the same way you summon an animal from their respective place such as the toads from mpunt myoboku (or however you spell it) or the way you summon team 7 nack from Kaguya's dimension. The blade of totsuka seals you in a dimension so it makes sense that orochimaru is summoned back.

Secondly, Kishimoto wanted to keeo Sasuke pure, almost every Uchiha has some sirt of additive. Obito and Madara had Hashirama's flesh, Sasuke did not, it's already been debated and proven that he used his knowledge of Hashi's DNA to help Sasuke but if you attach Hashirama's DNA you tend to have some massive body distortions, Sasuke did not. I'm glad Sasuke didn't have the curse seal because it just drains his life force anyway and it just links him back to Orochimaru who he has far surpassed at this point. Think of it this way, Sasuke is fighting with just his power alone with no help of others just like Indra nit even the main star Naruto can attest to doing that. That's not a nerf. Just because he didn't learn new abilities that weren't even hinted towards.

I see a nerf as giving a character something then taking it away for the purpose of plot. It did happen with Naruto but only in the form of Frog Kata. I can't remember any other instances where he was nerfed.

I call it a nerf if I want to. It is hinted that he should cancell out with Sasuke. His name means whirlpool and Namikaze means wind and waves.

He learned Wind style at similar time Danzo revealed his wind tech. Sasuke can channel lightning, Naruto should channel wind in more variety. Its been hinted throughout the whole series. I call it nerf on his character development, kishi held him back.

Now according to your def I say the only time Naruto was nerfed besides frog kumite was against Sasuke in vote2. Sasuke was nerfed also btw for obvious reasons.

Totsuka didn't seal Orochimaru completely, because there are several ones. You can compare it to the "Horcruxes" from Voldemort in Harry Potter. To kill/seal him off completely, you have to destroy every piece of him and that wasn't the case because Orochimaru basically split himself up by the help of the cursed seal.
