If you're asking why he didn't use it against Gaara in the chuunin exams, it's because killing was prohibited. If that's the case, Neji could have killed Naruto 3 times over.

You guys should watch it again, if it was fight to the death they wouldn't have stopped Neji from killing Hinata. Also, just because Gaara killed those guys doesn't mean it was legal.
