Question and possible plot hole: is Kabuto in permanent sage mode?

Just a general question here. Every scene after his defeat by Itachi and in the sequel at the konoha orphanage we see Kabuto with his Snake appearance traits which is odd because when Orochimaru took back his own chakra, when he was resurrected, he undid Kabutos sage mode reverting him back to human form.

Which implies that Kabuto can deactivate Sage mode if he wishes? So why would he choose to remain in sage mode when he goes back to the orphanage? Hardly makes sense...

That's because it was Obito's chakra carrying the Rikudo Chakra.
But Obito like the Sage just managed to move from the after life to the real world for short period of time.

His eyes change when he's in SM and he became a dragon not snake

He gave kakashi his eyes its prob different with those like you said hago gave chakra something he was known to do and he was a God
