What are you talking about. He deactivated it right after killing those mist ninja. When he went to touch rin. he had to deactivate the intangibility in order to actually grab Minato. do you not get how the intangibility works?

That's why he got hit with the rasengan and contract seal, otherwise minato wouldn't be able to touch him.
