The problem will come from the legality issue. Gender isn't nearly as charged of an issue as race. We don't have 'all women' neighborhoods quite like there are 'all black' neighborhoods or china-towns. Virtually all women have positive and negative experiences with men to use for reference against various rhetoric, while racial issues tend to be much more tense because of the difference in perspective amongst the groups.
From a legal standpoint, *** can be broken down into genetics. If you have a Y chromosome, you are male. If not, you are female. This is pretty simple and there are simply not enough cases to the exception to involve the government in them. Separate groups can be made for males identifying as women or females identifying as men.
Race is a much more murky subject.

What's the difference between a Serb and a German? I'm sure they could tell you - but to most Americans, they're both of the race "white" - which includes such heretical concepts as the Irish being the same race as the French.
In that respect, yes, race is more political.
Although, over numerous generations, political distinctions give rise to physical deviation. I was told that a Bosnian and a Serb can be told apart by the nose. Hell if I know how accurate that claim is... but the concept would be that since the division of the two, it has gradually led to some diverging physiology, just as the Germans are held as being anatomically distinct from French or Norwegian groups.
Whatever differences divided these groups at one point in time did eventually lead to physical and genetic distinctiveness.
Although exactly what those distinctions are is likely what led to the wars that isolated the populations in the first place.
