BJACKSON, Miss. (AP) — Ursula Miller knew that when she shouted her niece's name after she received her diploma at a north Mississippi high school graduation, she would probably be asked to leave the arena.

But she never expected Senatobia school district Superintendent Jay Foster, who instructed spectators to hold their cheers until after all students graduated, would file criminal charges against her.

Miller, a resident of the 8,000-person town 30 miles south of Memphis, Tennessee, is one of three people facing misdemeanor charges of disturbing the peace following the May 21 Senatobia High School graduation.

"I understood as a consequence I was going to be escorted out of the graduation, but no one told me there were going to be criminal charges against me," Miller, 45, told The Associated Press in a telephone interview Wednesday.

Foster didn't respond to requests for comment Tuesday from the AP. He told The Clarion-Ledger newspaper that the behavior showed disrespect to other graduates.

"I did go and sign papers on them for disturbing the peace," he said. "My point is not to have somebody have to pay money, but I want them to know there are consequences for their behavior, and I want us to have a dignified service."

Zabe Davis, the police chief at Northwest Mississippi Community College, which hosted the graduation, said Foster swore out charges against three people. Miller said a constable served her with the charges Monday morning at home. Pending in Tate County Justice Court, they carry a fine of up to $500 and a sentence of up to six months in jail. Miller said she's supposed to appear in court Tuesday.

Foster said he's worked to dignify graduations, stopping outbursts of cheering that prevent other student from hearing their own names. He said one student flinched last month when the cheering broke the silence.

"The look on her face when she was coming across the stage just reminded me, this is about the kids," he said. "So many things these days, if I had to sum it up in a few words, it's all about me. But this is not. This is about the graduates."

But Miller said she was only trying to celebrate her niece's achievement.

"That's what we do in our family, is we celebrate this occasion," Miller said. "She deserved that cheer and I would do it again."

Wow...seriously? I can understand kicking her out of the auditorium for breaking the silence, but arrested? Is that really necessary? Disturbing the peace? Our jails are already overcrowded and we want to now start throwing people in jail for celebratory outbursts during graduation?

EDIT: your poll, while yes the "blacks" are at fault, arresting them for this was uncalled for. It isn't against the law to shout out your child's name during a graduation ceremony even if you are asked not too.

Miller said herself she expected to be escorted out after the outburst. So they knew they were in the wrong for the outburst and accepted a reasonable consequence. Being arrested for this is unreasonable.

Let's not make it a race-thing. They was given specific instructions not to cheer. They did anyway.

Also, they school didn't file the charges, the guy did. Now, they are awaiting trail for the judges verdict. Hopefully, the judge lets them off.

OT: Yes she should be charged. She knowingly intented to do something that went against rules, and was even asked not to do said thing. She knew there would be consequences, reasonable or not.

What a strange thing. At my graduation, Mother cheered for me just as the family and friends as others did. Someone's name would be announced and there would be an appropriate gap between names so applause could be done. I suppose it is different at every school. Very strange.

Anyways, graduation was amazing. Mother and I stayed up all night talking about our future together. That was when we decided we should go to Egypt and Paris and every place we wanted to travel to together. We fell asleep in others arms that night, smiling.

Now if there were other culture people among the screaming ones who weren't punished then you might have a point, but this just makes it appear like you are pulling the race card in hopes of a hot discussion. Race is irrelevant here and yes they should be punished- people can't be like 'imma hurt someone and take the damage' that doesn't justify damage done to the victim.

And people saying the dude is over sensitive think about it - a flinch in body sure but what in mind? People usually shut down when in front of public for all we know that girl could be having anxiety like hell, not to mention this is like 'the moment' for those students- once a lifetime thing.

In fact it was insensitive/selfish/shortsighted of the women to scream, glad she was taught a lesson.

Why's she gotta have blonde hair ya racist? On a serious note, punishments need to act as deterrents, and why most of us may find it harsh simply asking people to leave after having already seen their family graduate wouldn't deter people from doing it again. Being arrested and charged just might, and it's definitely more likely to deter others than knowing they'll just be asked to leave. I think a better though not perfect solution would be to take back the students diploma if a family member cheers. The main downside would be you'd be punishing the kid for the parents behavior though.
