They both comitted crimes. But Sasuke got away mostly scott-free even though he should have spent the rest of his life behind bars.

I always thought that chapter 700 should have featured Sasuke getting released from prison. But what Orochimaru did to Kakashi's village...I wouldn't have never imagined that he would just be cool with all of that.
