Nah, you're underestimating Oda's writing. There's a chance that he can die. We've had 4 people in the series die already and that's obviously not including flashbacks.

Before the flashback I would have said he will have retreated or left beaten for Kaido of the Beasts to take out. But now that we have seen Doflamingo and Laws past law needs to be the one to finish Doflamingo. He needs to get payback for what Doflamingo did to Rosinante. And that will probably enrage Kaido causing Law and Luffy to join the Kid alliance.
