he retained the sand from when he was a jin so gaara does not count

I was plainly stating that it is not known rather gaara had this power before One tail. Actually it is shown that Gaara still shares a connection (possibly through his kekkei genkai) because he was able to extract it from the one tails, even though it was extracted. It can be inferred that a tailed beast can make it's jinchurriki acquire certain abilities (I believe Son Goku's jinchuriki could use a magma jutsu).

Since magnetic release/sand is an attribute of the one tails, it can be assumed that's where Gaara might have obtained it.
