Itachi was the badass of part one hands down.
Madara was the badass of part two hands down.
Regardless, both are badass throughout the series, overall. U_U
Honorable mentions would be Zabuza and Pein. No one else to be honest.
Being badass is when one follows their own code or set of ideals they believe in, without contradictions. They do everything they can to achieve it. It's not supposed to be used as an adjective in literature, it's more of a trope or archetype.
Tobirama would fit in, however, he doesn't due to the results of nearly every major fight he's been in (he loses badly) and how he handled the founding of the village. He contradicted himself several times, he supported a time of peace where children wouldn't die, but decided to set up a system where children would be soldiers and fight to the death in the Chuunin exams. He didn't exactly have a set limit for what he wanted to achieve, he basically let his paranoia guide him as far as decision making goes, which had pretty bad results in the end and caused numerous problems.
Also, some other characters do have epic moments, but they aren't badass characters. To be a badass character, they need to consistently keep up the persona.
