that wasn't stupid. Sasuke was actually going to die. Kabuto changing teams and showing up when he did is what saved Sasuke. More to the point, it seemed to be against Madara's code to hit ppl that weren't in any condition to fight back. He was too talented to be that kind of opportunist anyway.
