I guess a trial would be good, taking into account what he did before and after he came to the battlefield.

I suppose a trial would be necessary, especially if he wants to be Hokage.

In any other circumstances I'd say definitely yes he needs to be punished.

But seen as the current hokage and village system made his brother annihilate his entire clan and carry the burden of rogue ninja on his shoulders, I think maybe after the events of the war the current Kage can see where their legacy has gone wrong and as a result of their ways has led Sasuke down this dark path.

That is the only justification I think would make Sasuke's return acceptable.
