I just realised, in this scan, Sasuke never even shot the fireballs and it wasn't cloudy at all. The jutsu would have never even worked.

Orochimaru later asks him why he didn't kill them, he says that the only person he wanted to kill was Itachi and he just wanted to scare them off. If he wanted to use Kirin, I'm pretty sure he would've shot a fireball at the sky cause he wouldn't want to waste his chakra if the jutsu didn't work. Also, the handseals aren't the same ones in Itachi vs Sasuke.
