Madara's Susano'o had legs in the fight against Hashirama in the anime whenever Izuna died I'm pretty sure. Also, didn't he use it during the VOTE fight?

Itachi's stamina was garbage, anyways. Itachi never even, from what I've seen, needed to use it anyways. The only time we've seen him use it was against Sasuke and when reanimated.

We've never even seen Shisui use it in the manga anyways.

Though I don't see Itachi ( who gave Shisui's eye to Naruto and wanted to save Konoha at any cost) or Shisui ( who rather died than letting people fight over his stolen eye) objecting. And Sasuke too despite his surprise seeing Kakakshi using sharingan again seem to have gotten over it. Madara wouldn't care. Let his find his upper body first.
