He hasn't used the eye before, but he said he reprogrammed it to "protect Konoha" meaning, the eye deactivated once he programmed it.

The only logical answer is that he reprogrammed it and the eye deactivated after that.

OR, Shisui used the eye and it was already "deactivated/resting)" when he gave it to Itachi.

So you're saying the eye was already activated on 1 command when Shisui gave it to Itachi? Then Itachi switched it to another command & because he changed the command from 1 to another, then it automatically had to reset the ten year activation time?

Maybe what you are saying is this: "In order for him to program KA, it must be usable" and that "if its not charged all the way up & ready for usage, then he cannot program a command in it"?
but don't forget just because something is not already available to you, you can set preparations for it in the case of an Uchiha's eyes.
Sasuke hadn't used amateratsu before but he used it because Itachi programmed it in him to activate , before Sasuke ever awakened his own MS.

He didn't use it because it can only be used once in a decade, so he was saving it for Sasuke (and in the end it was used on Itachi himself to rewrite Edo).

It was already deactivated and he reprogrammed it during the rest period, so it would immediately be ready for usage once it was recharged

The eye was never shown to be used, so I conclude that it was activated, but Itachi reprogramming it must have deactivated it.
