No he is not necessarily dead. Giselle can control shinigami even if they are alive. But she can only control QUINCY if they are dead. So Toshiro may still be alive and it is likely he is as I don't remember him dieing.

Its funny because a lot of people say that kubo seems to never kill off major characters but when one seemingly dies they complain for one reason or another ( not saying you guys are is just kind of ironic) and I seriously hope that when she dies(which I hope she/he gets f***ing mauled) everyone will be released or something like that. I hope kurtosuchi goes freakin bankai on her/his pale a$$ and wipes the floor with her.

Sadly I am with you on this, and I know a few people that might also stop cause they are big Toshiro fans. I never liked when the main good guy characters died in other manga's and in this one also. Lets just hope TK doesn't mess this up and kill him off that would be a bad move
