The only reason that sasuke won this battle was because orchimaru had his hands paralyzed if orchimaru was at full power sasuke wouldnt still be here and no this isnt to get sasuke fapboys mad its just the truth.

And at the time when kabuto was healing orchimaru wounds from his battle with the third hokage sasuke took advantage of killing orchimaru knowing he couldnt using any hand signs or justus if orchimaru had the chance to fight sasuke again after sasuke brought orchimaru back from anko's curse mark

Orchimaru might beat sasuke even thought he has his mangekyou sharingan but knowing the power of this type of power from the sharingan from his experince with his little battle with itachi he could have counter the genjustu part of sasukes sharingan.
