Kabuto is far too powerful. He has arguably better chakra control, medical ninjutsu, a good deal of the snake variants that Orochimaru has. Not to mention the most talented shinobi all incorporated into his being that Orochimaru used.

He has Kimmimaro's DNA.

Kimmimaro bone-field covered the desert and was strong enough to pierce through Gaara's condensed sand. Added with Genjutsu, Kabuto can manage against the 8 headed snake.
