Shisui couldn't kill him in order to prevent being the catalyst to his own clan's usurping of Konoha. If Danzo, a village elder, was killed, the village would of immediately suspected (they were already closely monitored) the Uchiha and a civil war would of begun, which is precisely what Shisui wanted to avoid.
