Within these conditions Orochimaru's durability comes to play as he has little offense in pure taijutsu department. If Lee can cause enough damage that has enough DC to force him oral rebirth he would take this. If not he loses.

Oro either simply outlasts or tanks all. He's been literally bisected, he's had limbs cut off, he's tanked corrosive chakra, he's used Oral Rebirth two times in one fight and was still going on. We don't know for how long Lee can keep up the 6th Gate, if even Gai couldn't keep it up for that long.
