I have always wondered that too. Maybe it's like getting the mangekyou sharingan to begin with, or activating the sharingan period. Maybe you have to feel more loss and the stronger the blood connection the stronger the eternal mangekyou sharingan. All forms of the sharingan confirmed by the second hokage to be tied to strong emotion when the edo hokages were explaining the history of the hidden leaf to sasuke.

MS doesn't require one brother killing the other to be unlocked, only the most extreme emotional trauma and one taking the other's eyes.
