It's simple, really.
The SO6P split his powers up between his two sons. His older son got his eye powers. His younger son got his body powers. The SO6P's body powers, which was the juubi's/tailed beasts strength, became the power of mokutun in the younger son, as shown by the Senju clan. Therefore, the SO6P's rinnegan became the sharingan as shown by the Uchiha clan.
To gain the rinnegan, you need to combine the power of the Senju and the Uchiha, to gain the eyes of the SO6P. How could the Elder Son have the Rinnegan when his descendants (Uchiha) needed the power of Senju to gain the same eyes as the Elder Son and SO6P?
This leads into a possibility that the Elder Son actually did have his own form of Dojutsu.
Edit: New possibility, what if his eyes were just EMS and the Byakugan fused together, with the byakugan being the weaker one, which explains why the Uchiha clan were his descendants as the sharingan was more powerful?
