I don't think it should count since he'll die if he uses his power. It's similar to arguments about Izamami or Izanagi. They won't really use them in a fight since the cost may out weight the benefits. Especially in Gai's case. A win isn't a win if you die imo.

Gai's position doesnt change, yes he may be able to destroy high level opponets with his powerup but by this logic RDS should make hiruzen & minato top 5 as well.

If you die during a fight or as a result of a fight then it's a stalemate at best, you aren't stronger than your opponent even if you end up killing them.

8th gate is suicidal. It won't give the user victory but a stalemate at best. It's like RDS. So no.

8 gates brings him to top 5 even though we all know he dies, he trumps almost anyone with 8 gates considering the fact that he's taking on Madara as a juubi jin, something that the entire shinobi alliance could not do. He had madara at a point where he couldn't even move. hardly anyone can contend with 8 gates guy considering none of them could contend with blind madara, and he's taking on rinnegan jinchuuriki Madara. to claim many ppl stalemate with him is pure comedy. he's top 5 with 8 gates even tho it doesn't last long.
