ya i dont think the drs would work given 2 facts. 1) you most likely have to be alive to use the drs considering it takes youre soul as well and i dont know any characters that could use it that are currently alive. 2) its already been shown that you can pull souls back out of the drs. what if someone was on madaras team that we werent aware of? shoot what if oro went back and braught him back with edo tensai and took over the leaf with him. not gonna happen.
