Before saying asspulls, read the mange. Kisuke gave everyone that lost their bankau the means to get them back...

Byakuya was not there to receive the means to get his bankai back. He was & possibly is still in a coma. Also as for Byakuya's zanpakuto... (i heavily argue this) it was pretty much destroyed. It desintegrated after he was beaten up and slammed into a wall all bloodied. It was at that point he asked Ichigo to bare the burden of saving everyone and Soul Society, to bare the weight of it all even though it goes against Byakuya's honor. Then the remains of a fragment of blade, the hilt and handle desintegrate in his hand. Which would also mean the death (even if temporary knowing Kubo) of the zanpakutos own soul. This would explain Byakuya's coma as Shinigami and Zanpakuto have one shared life (explained long ago in the beginning of the series as well as the noncanon Zanpakuto Rebellion Arc fillers).

So long story short As Nodt cant use what is destroyed, even if he stole it for himself, its still bonded to the original wielder and thats the decision of the Zanpakuto.
