i want to know what his previous 2 strikes were, i don't want to make any claims without knowing everything but it's possible he did a low crime intentionlly to make the third strike case complicated. if he doesn't get in jail for it and then do another crime, he can claim it's not his third strike and that they had a chance to blame him for it and lost. so now his is technicaly free.

again, i may be wrong. but people use those broken system to escape punishment just as well as to punish innocents.
