There are many possibilities when considering any character's arsenal & I'm going to present my views about it.
1.1) gift from other character.
eg: obito->kakashi(eye), itachi-> sasuke, madara->nagato(rinnegan)shisui->itachi(eye)
If the gift is a special/unique organ,or something the receiver cannot ever attain, then that should not be considered in the arsenal of the receiver.
However, if the gift is a powerup, then it can be considered,as its equivalent to learning the jutsu.However, it should be confirmed that the receiver was capable of learning the jutsu by any other means too.
1.2) Jinchuriki
Its a tough call on this one.Firstly, its a simple powerup, & quite unfair as its not something the receiver has attained, however, not everyone can become the jinchuriki, so its a 50-50 thing.So my logic says that if the ninja(in his prime) is capable of defeating the tailed beast on his own, then he has the right to consider the beast in his arsenal.
2) edo ninjas
pretty evident that edos seem stronger sometimes than their living form. so I believe that for these ninjas, either their prime state, or their state during death should be considered. However,it should be noted that jutsus performed by them in edo state, ALWAYS belong to their arsenal. Infinite chakra of edos can only increase the frequency of the jutsu. many people believe that a jutsu done by a ninja can only be done in edo state.....thats wrong, because if he knew that jutsu, he must've performed it earlier in living state.
special case: minato-> the KCM belonging to minato was obtained by him before his death, so it will belong to his arsenal, and not in just his edo state.
3) using body cells
eg: madara, oruchimaru, kabuto, obito,danzo
in oruchimaru,madara & kabuto's case, it can be considered as they used their own skill/knowledge to obtain them.whereas for obito, it was madara who implanted into him, or for danzo, oruchimaru did it, so its not acceptable.
4) Jutsus requiring preparation
Although they can be considered in one's arsenal, they shouldnt be considered in VS threads or while forming the top 10 list. for eg: edo tensei
On this basis, my top 10(not in order,but in levels):
level 1: hashirama,madara,itachi,minato
level 2: tobirama,hiruzen,oruchimaru
level 3: shisui,kabuto,hanzo
