We're not sure he wouldn't have died with full chakra anyways. If so, there wouldn't be a need for Obito to die to bring back Madara with rinne tensei. He's most likely gone either way. And its not stupid to realize your errors and fix them in the heat of the moment the only way you can.

RINNE TENSEI _ Nagato awakened the abilities of the Rinnegan .. Obito just borrowed the eye..
-Obito suggested that if he used Rinne Tensei on Madara , Madara thought Obito would die (according to Obito)

maybe because Obito only had 1 rinnegan, low chakra, not uzumaki, (1 of those reasons perhaps)
perhaps Konan thought Nagato would survive because Tobi lied and suggested that Nagato would live through Rinne Tensei since he will say & do anything to get what he wants.. afterall Tobi is the one who told them information about the Rinnegan ..

as far as Nagato being dumb goes.. these aren't the exact translations I was looking for , but in others they called Nagato an idiot & a fool possibly.
