Well he´s implied intention to use the Ningendo, but Kabuto needed Yamato alive, not souless. And the Six Paths of Pain technique plus the Tailed Beast Control ability he´s used are derived from the Seventh Path, the so called 'Outer Path', which also includes the Rinne Tensei into it's category. So certainly, he can always use them but they´re all chakra-taxing.
