he is only doing one of two things, he is prob setting up for kirin OR he is go to go crazy with the black flames to defeat his enemy, showing how cold and heartless he is while still effectively killing his enemy(jus showing his dark side)

Orochimaru cares more about controlling HEALTH/PAIN than Pein/Nagato did.
Orochimaru remembers TSUNADE trying in vein to save DAN. He was so sad/somber/depressed during that scene.
He sees TSUNADE in the situation DAN was in & the situation OROCHIMARU himself was in most of his life do to the body changing jutsu he learned.

OROCHIMARU will bring back SHISUI later and MABUI/AO were spared when HQ was destroyed.
AO will be killed by EDO SHISUI. SHISUI will later tell SASUKE that he cast KA on ITACHI to protect the village from the threat of the UCHIHA's REBELLION. (ITACHI's LOVE for SASUKE spared SASUKE's life, also the fact that SASUKE didn't know about the PLOT so he wasn't a threat to the LEAF. Other Uchiha kids probably knew, or not because they would be liable to being put under interrogation from the LEAF loyalists.

ITACHI had the reasoning of HOKAGE , but all the HOKAGE make mistakes just like their underlings.
If the reasoning of a HOKAGE meant taking ALL NECESSARY ACTIONS, then this war would've NEVER happened.

but the WAR happening is the best thing that EVER happened for the SHINOBI WORLD.
