After Sasuke and Itachi's fight Obito goes to the battlefield to get Sasuke. Zetsu informs Obito that Itachi had the two legendary items, so Obito activates his MS and notices the two items next to Itachi and picks them up.

I know if he had them he would have used them to save himself from Konan's explosive tags. I think it is pretty obvious that Itachi some how incorporated them into his MS, just like he was able to do with Shusui's eye. Sasuke has to have them. They have been around for a long time, and I don't think they would be destroyed just because Itachi died while using them.

Maybe they reset like how a Bijuu will reform after sometime when their Jinchuriki dies.
