If he can break himself out of Edo tensei, he should be able to do that.

Or at least use it On Fugaku, as he was leading the whole group.

Not really, using it on Sasuke's Dad the leader would of sufficed. But Danzo didn't let shishui do it when he tried. I guess he had to wait for it to recharge after the failed attempt

Well actually that's wrong, we already know nearly every Uchiha member get's influenced by the "Curse" and so will sooner or later plan to do what they was going to do before.

Edit: Even if it only happened when Fugaku died it would have still happened.

the eye Danzo stole was the 1 Shisui was trying to use on Fugaku (Uchiha leader)
