Don't be silly :/ How could Madara obtain EMS if his brother didn't have MS, and I think he was tired -.- he did just get slashed by Tobirama so I hardly think he'll be brimming with energy

MS isn't permanently on, you do know that right ? You can switch to MS and normal sharingan at will. we've also seen Izuna in the manga with his MS

Because he would've deactivated it, he's mortally wounded and you wouldn't want to go on wasting chakra in that state, otherwise he would've died on the spot.
