You said the match takes place during the 3rd exam, even if its acceptable to use it Sasuke is unable to use it since it has been sealed.

Even if he did have the curse mark, the level of the curse mark that he is using would not be strong enough to beat Neji. Only CM2 + 3 tomoe combo is formidable enough to really take him on and possibly beat him.

Sasuke can't even use CCS2 mode for long plus he can't use it according to the OP.

And how does he do this? Sasuke can only keep up his speed for a little while unlike Lee because He copied the forms and trained his body to adapt to those forms. As soon as Sasuke starts slowing down, he will lose to Neji's superior CQC skills. He needs the CM state 2 to give him the extra boost in speed for long enough to help him outlast Neji and even then it will still be tough.
