Can Madara Use Susano'o while Rinnegan Is Activated?

But on topic! If this is true, then couldn't Nagato have used his susano'o since he had Madara's eyes that had previously been EMS sharingan?

Thats supposed to be madara using perfect susanoo. He is using rinnegan then.

Madara can use ems techniques since he has ems and then evolved it into rinnegan
Nagato can only do rinnegan techniques because he only got a rinnegan transferred in his eyes

No, Nagato could not use Susano'o because even though he has Madara's eyes, Nagato did not develop the eyes.
Nagato got the end result, without having to go through the MS/EMS cycle.

tricky one but maybe it had to do with nagato not being an uchiha. he might have been able to use ems if he wasn't an uzumaki.

uzumaki + uchiha = rinnegan

Due to the rule of transplanted Dojutsu (Sharingan) that states "A transplanted Dojutsu can't be switched off" Nagato can't switch off the Rinnegan and go back to the Sharingan. Madara can use Susanoo with Rinnegan active only because he has access to Sharingan and Rinnegan powers. Nagato doesn't.

Nagato only possessed the Rinnegan unlike Madara and Obito who had Rinnegan/MS/EMS Madara and Obito are able to use both simultaneously
