Well wait a minute. Somebody did die: Izuna. In one battle Madara has regular sharingan and Izuna is wounded. In the next battle he apparently has EMS. This suggests that Madara killed Izuna to gain MS, and then used Izuna's eyes to gain EMS. But then where did Izuna get his MS from? All very weird. Based on the evidence so far, Madara didn't appear to have his MS eyes until AFTER Izuna was wounded.
