Oro stabbed her 3 times with kusanagi.He wanted to kill her.He just couldn't.After she used her summoning Oro and Kabuto got their asses kicked and they fleeted.

Yes he took advantage of her sickness, what's the problem with it? He knew his opponent weakness and used it against her, he used strategy and fought her legitimately.
