If your theory is right then Madara could summon Gedo mazo. This would cause many problems for Tobi to mantain his bijuus.

It has never been stated that you need a contract for Gedo Mazo. Since both Tobi and Nagato are using Madara's eyes we can safely assume Madara can perform it too.

the uchiha were already one with the senju unlike kakashi who is not related to the sage,the uchiha and senju were once one before so they are compatible if you inserted the dna in them.
