First of all the reason sasuke would get special treatment is because he is kishi fav character lol. Anyway its because he is the second main character and usually main characters dont die.
Also look at it this way, right now the village allianc dont stand a chance. They are against an ems user who can use mokuton and has the rennigan, Another who has the ms, rennigan and and 6 jinchuricki paths, 7 tailed beasts, and ems user, kabuto, countless zetsu clones. The village alliance strongest hope is itachi and naruto who is running out of chakra fast.
Personally believe that the stacks are against the village alliance so much that, they would more than welcome sasuke on their side. This is why i say that if they do win the war, he would be forgiven
Kishi is a grown man able to make good decisions, just because sasuke is his favorite character to draw doesn´t mean he will ruin his own story he worked so hard for all these years by doing stupid things with him, sasuke is a main character and they don´t usually die but Naruto is
the main character.
Kishimoto knows that if he made sasuke kill people became a criminal, joined with a man that killed the leader of his village, joined with a group that is trying to take over the world and attempted to kill his friends dozen of times then he damn well knows he can´t make the joing together in the story and everyone smiling saying "welcome, sasuke-kun".
As i said, he would ruin years of work if he fanboys which he don´t cuz he´s the creator of his story, not a fan.
He knows his manga would drop like a rock in status.
Sasuke can just try to fight Tobi on his own without joining sides, protect naruto, sacrifice his life to kill tobi but do something that will help naruto beat him in the end.
That way, he will have earned respect and admiration of the world cuz he had done the right thing in his last moments before dying, he would be a hero in a sense.
