Now that Itachi came back to life yeah it's his eyes in that particular scenario but in reality they are still Sasukes because Itachi is dead man.

Look up the definition of "alive" and "dead", then check back to make actual sense. Zombie's aren't living people. Itachi's eye's are in Sasuke's possession, but they're not his actual eyes. Itachi being alive to claim them is a cop out, and makes no sense.
